The court went silent when the
Investigating Officer narrated how the
suspect a youthful Susan Nasimiyu
cousin to the deceased, 5 year old
Godwin Wekesa who was living with her
within the sprawling slums in Kiambu
County Kenya died painfully from
injuries inflicted through daily
beatings.
As Nairobi’s Chief Magistrate Bernard
Ochoi granted the State prosecutor
Gachoka’s filed application seeking to
detain the suspect Susan Nasimiyu for
more days in police custody for
investigations be completed.
Though a Miscellaneous application
submitted before a lower criminal Court
at Milimani Law Court Nairobi, while
presenting the inflicted injuries all
over the body of the deceased through
images which are very disturbing and
cannot be printed , the Magistrate in a
ruling ordered the suspect be detained
and further stressed that the State has
surficient prove that they need more
days to conclud investigations relating
to the alleged offence stated.
The suspect from Trans Nzoia County
faces murder charges contrary to section
203 as read with section 204 of the
penal code and if found guilty may spend
the rest of her life in prison since
capital offence is punishable by death
or life imprisonment .
Nasimiyu who lived with the deceased for
five months after she brought Godwin
Wekesa from her rural home when the
deceased lost both his parents was
arrested on Friday 09th December and
booked at Kiambu Police Station under
Occurrence Book number 15/9/12/2022
later transfered to Gigiri Police
Station where it was again booked under
OB 19/09/2022 which was the jurisdiction
of the area within Githogoro sprawling
slums where the alleged crime was
committed.
“The investigating officer need more
time to secure post mortem report as
autopsy on the deceased body is yet to
be conducted , record statements from
the suspect and witnesses and also to
visit the deceased rural home in Trans
Nzoia to get more information on the
past living conditions” said the State
Prosecutor Gachoka in his submission.
