Kenyan officer commanding police
station (OCS) Samir Yunus pleaded not
guilty to one count of abuse of
authority contrary to section 24 (2)
(a)of sexual offences act .
The accused who was arrested on monday
5th December appeared before Nairobi’s
Chief Magistrate Micheni Wendy Kagendo
on Wednesday 7th where he was charged.
The State prosecutor Anderson Gikunda
informed the court that on the 15 day of
June, 2019 while based at Dandora
Police Station within Nairobi County.
It was alleged that the accused took
advantage of his position of authority
and had sexual intercourse with the
complainants female officers stationed
at Dandora Police Station.
Investigations by Internal Affairs Unit
investigated the conduct of the accused
who served at Dandora, Kamkunji,
Mombasa Central and Pangani Police
Stations prompted by several complaints
which emanated from female officers at
Kamkunji and Dandora Police Stations in
mid 2020.
The Officers wrote several complaints to
Inspector General and IPOA claiming
that Samir was using his position as the
OCS to force them into having sex with
him.
Those who declined were being harassed
and transferred unprocedurally.
Further, the ladies complained that
chief Inspector Samir used his
connection at Vigilance House to
engineer disciplinary actions and make
life unbearable for them.
It was against the above background that
former Inspector General, Mr. Hillary
Mutyambai directed Internal Affairs Unit
to commence inquiry into allegations
against Chief Samir and on completion
forward findings to his office for
action.
During the investigation, one lady
officer narrated how Samir ambushed and
sexually assaulted her in South B Police
line, however despite filing complaints
at vigilance and DCI headquarters but
nothing happened. Others too had similar
experience. Inaction at vigilance and
Mazingira house forced the Officers to
complain to Inspector General and IPOA.
The main complaint came from an Officer
from Dandora Police Station who accused
Samir of raping her within report office
late in the night.
The IG on receipt of IAU file gave
instructions that the file be submitted
to ODPP to review the findings and
determine wayforeward. It us on this
premise that the ODPP upon perusal of
IAU file was convinced that there was
enough evidence to sustain charges of
abuse of position of authority contrary
to section 24(2)(a) of Sexual Offences
Act, 2006.
The accused was the base commander
Ruiru station , he will appear in court
4 20th December for pre trial.
He was released on a bond 500,000 surety
of the same or a cash bail 200,000
with one contact person.
