HIGH COURT URGED TO DISMISS DPP HAJI PETITION

HIGH COURT URGED TO DISMISS DPP HAJI PETITION

The High Court of kenya urged to

dismiss the application filed by the

Country Director of Public Prosecution

Noordin Haji and order him to appear

before Public Service Commission to

defend himself on several allegations of

gross misconduct filed before the PSC

by different Petitioners.

The third respondent while responding

to application filed before the High

Court by DPP , the PSC accused the

Country DPP whose office is Protected

by the Constitution of being suspicious,

guilty and is now threatened by the

allegations , and is seeking shelter

from the high Court to stop the civil

servants employer from hearing his side

of the story after serious allegations

of incompetency and jeopardising justice

level against him .

The Country Constitutional lawyer

Danstan Omari is representing the third

respondent Public Service Commission

before High Court in the matter filed

by the DPP .

In responding to DPP Petition through

lawyer Danstan Omari, the High court

has no jurisdiction to entertain Haji’s

petition because it would amount to

controlling how the commission carries

out its mandate.

Public Service Commission through

Danstan Omari is urging the high Court

to resist attempt of it’s process being

abused by people accused of gross

misconduct .

Public Service Commission Chief

Executive Officer Simon Rotich reminded

the applicant in commission response ,

that it has a constitutional mandate

under article 158(2)and (3) to receive

and consider a petition for removal of

the a Country Director of Public

Prosecution.

And in Article 157(1) of the

Constitution , to send the petition to

the President who has power under

Article 158(4) to suspend the DPP from

office and to appoint a tribunal to

inquire into the matter and make

recommendations to the President.

The DPP got orders barring the Media

from reporting on the content of the

first and second petition filed at the

Public Service Commission seeking for

his removal .
