HUSTLER FUND LEGALITY QUESTIONED BEFORE COURT

By Chris Ojow

Linda Ugatuzi organization seeks court

order to stop the newly appointed

hustler board members from executing

their duties on ground that the said

board was formed after the project was

officially launched which according to

them is a breach of law.

The organisation in several of their

prayers in application before court

also seeking for the formulas on how

hustler funds works inline to the

Country laws.

The organization claims that the

President chief patron of the project

has no physical office nor entity in

their application filed before High

Court Judge Lady Justice Monica Mbaru.

The organization lead by Prof. Fred

Ogolla are much disturbed on why

innocent Kenyans who are applying for

loans from hustler fund are being

subjected to give their personal

details like the pin numbers?

In their application they also alleges

that inline to the law, the Country

National Assembly has not approved the

ruling party coalition Kenya Kwanza

hustler fund project which render it

illegal.

The President of Linda Ugatuzi

organization Prof. Ogolla alleged that

the Judiciary is under state capture,

after their matter failed to proceed on

grounds that parties in the matter

without apologies before court

intentionally failed to log on

virtually during the mentioning of

their application.

They alleged that such a fund must be

created through the act of Parliament

and must be enshrined in the Country

National budget.

The organization alleged that

regulations act 14 (1) was breached,

as Kenyans are yet to be told which

bank authorizes such savings and how it

was arrived at.

On Tuesday 31st January 2023 was the

second mention of the matter filed

under certificate of urgency in early

December year 2022 contrary to other

applications under the same nature.

It is also alleged that the parties in

the matter has not filed their

responses, a breach to the court

proceedings which the organization

claims that they are being treated with

soft gloves contrary to the court

guidelines.

Professor Ogolla is now calling for the

Country Chief Justice Martha Koome to

intervene on how their urgent

application is being handled casually.
