POLICE TO RESUME DRAFTING CHARGE SHEET AS APPLICATION FOR JUDGE MRIMA REMOVAL FILED

The Court of Appeal has stayed a

decision by judge Antony Mrima which

gave the DPP power to draft and sign

charge sheets.

This means that the mandate had been

given back to the National Police

Service and other investigative bodies

such as the EACC and KRA.

Following judge Mrima’s judgement which

has brought chaos in the criminal

justice system, a petition for his

removal has been filed before the

Judicial Service Commission by an

activist.

The activist, Fredrick Bikeri wants

Judge Antony Mrima be removed from

office on grounds of gross misconduct,

partiality, bias, corruptive practices

and breach of chapter six of the

constitution.

According to Bikeri, the judgement has

created confusion within the criminal

Justice System.

The activist argues that petition the

Judge delivered a ruling out of prayers

that were never sort.

This is after the DPP, through a press

statement, denied praying for powers to

sign and draft charge sheets before

judge Mrima.

Addressing members of the fourth Estate

at Milimani Law Court, lawyers Danstan

Omari and Martina Swiga for the Activist

said, “to be fair to the accused and to

avoid applications being filed at the

High Court seeking to quash charges,

the accused who were charged with the

DPP signed and drafted charge sheet

should be charged afresh with a signed

police drafted charge sheet.”

It is also alleged that thousands of

files are lying at the office of

Director of Public Prosecution caused by

the delivery of the ruling .
