filed before Lady Justice Hedwig
Ong’undi seeks for an order
prohibiting Odinga’s team from
breaching the law by declaring monday
to be a public holiday.
Through his lawyer Harrison Kinyanjui
the applicant sued Azimio leader Raila
Odinga, Kalonzo Musyoka, Jeremiah
Kioni, Martha Karua, Eugene Wamalwa,
Azimio la Umoja One Kenya Coalition,
Wiper Democratic Party, George
Wajackoya, Wycliffe Oparanya, CS
Interior, Inspector General of Police
and the Attorney General.
The applicant is seeking an order
prohibiting Odinga’s team from
breaching the Country laws.
Sonko seeks court directions ordering
Cabinet Secretary for Interior Kithure
Kindiki to order Inspector General to
arrest Raila and his team for breach
of law.
In response to the application filed
before it , High Court laid down
procedure for the declaration of public
holidays in the country and described
the suit as of great public interest.
Raila Odinga who lost in 2022 general
elections and filed a petition before
the supreme court where Dr. Ruto’s win
was upheld , has continuously held
several rallies within the country
alleging that his win was stolen.
“upon perusal of the prayers I have
not found out any gazette notice by
Cabinet Secretary of Interior
declaring Monday a public holiday as
per section 3 of the public holiday’s
act,” said Justice Ong’undi.
The Judge directed the applicant to
serve all the parties pending
proceedings on Tuesday 21st.
