Appearing before Nairobi Senior
Principal Magistrate Zainab Abdul at
Milimani law court, a youthful
businessman’s long journey along the
corridors of Justice came to a halt
after he was acquitted from several
criminal charges.
Frank Onchagwa Nyabwari breathed a sign
of relief at the end of judgment
delivery, after Senior Principal
Magistrate stressed that the State
prosecution failed to prove their
allegations against the accused.
Frank was charged years ago with eleven
counts of conspiracy to defraud, giving
false information, attempt to obtain
and obtaining with false pretenses.
Where he was accused of unlawfully
obtaining millions of Kenya shillings
fraudulently.
The state Prosecution during the trial
lineup several witnesses to testify
against the accused over allegations of
unlawful obtaining millions of money
through unlawful business transactions.
And on Friday 24th year 2023 early
morning East Africa Time , it was a
sign of relief after the court freed a
youthful prominent businessman from
criminal offences.
Whereby an order was also made for the
freed accused bond be refunded back to
him.
The Magistrate in her Judgment blamed
the State for failing to prove their
allegations against Frank.
“When it comes to conspiracy charges, it
is difficult for an individual to
conspire to himself, conspiracy involves
several parties,” the Magistrate
stressed.
Frank while leaving Milimani law Court
after being set free , said that he has
forgiven his tormentors , describing
the ugly embarrassing ordeal as
politically manufactured to prevent him
from political engagement and a pure
political witch-hunt to destroy his
image and reputation which he struggled
to build.
