As an employees of Galot Industries Limited, Rajeev Modi the second petitioner, the third petitioner Pushpinder Singh Mann and the fourth Petitioner Jophece Yogo .

Under the direct management care and control of the first Petitioner Mohan Galot who is Rajeev Modi and the other two employer as Managing Director.

Are shocked and emotionally disturbed that Pravin Galot and Rajesh Galot allegedly and maliciously reported a complain at Muthaiga Police Station Nairobi County Kenya.

On the basis of fabrication and falsehood that they were Directors at Galot Industries Limited and Manchester Outfitters Limited.

Pravin Galot and Rajesh Galot through their never ending blackmail, allegedly gave false information to law enforcers that the second, third and fourth petitioners had committed an acts of perjury against the Companies Registrar act.

The second, third and fourth petitioners were arrested on the basis of Pravin Galot and Rajesh Galot fabricated lies and calculated blackmail.

The three employees at the first interested party were arraigned before a lower criminal court in Nairobi and charged with alleged fabricated offence of Perjury.

Each were charged with several counts contrary to section 108(1)(A) as read with section 110 of the penal code.

False swearing, contrary to section 114 of the penal code after Kenyan Law enforcers based at Muthaiga Police station Nairobi County.

Without making any effort to verify the wild allegations fed to them by Pravin Galot and Rajesh Galot with the Registrar of Companies.

If indeed the second, third and fourth petitioners were registered as Directors of the first and second Interested parties .

A well schemed fabrication, lies and blackmail against the petitioners who are employees of the first Petitioner Mohan Galot the Valid Director of the Galot Industries Limited Ascertain by the Registrar of Companies Kenya.

In a strange move and direct opposite to the laws of the Republic of Kenya, the law enforcers while energetically acting on the well schemed lies fed to them.

The three petitioners were arrested without preliminary investigations being done or carried out to ascertain the authentication of the alleged offence.

The decision to arrest the three petitioners and prefer fabricated charges against them was unfair, a violation of their rights in line with the new 2010 Constitution of the Republic of Kenya.

The Officers at Muthaiga Police Station Nairobi County at the time of arrest misused their powers against the laws of Kenya which was very careless and unjustified.

The respondents also in a careless and unlawful move, without counter checking with the Registrar of Companies instituted criminal proceedings in case number 95 of 2019 and criminal case number 2374 of 2018.

The cases before Chief Magistrate Court Nairobi are vexatious, oppressive and total abuses of power by the Law Enforcement and State Prosecution Officers.

Following the unjustified arrest and preference of fabricated charges against the second, third and fourth petitioners.

The three filed a Constitutional petition before the trial court 2019 as matter of breach in the 2010 new Constitution of Republic of Kenya.

Under the Protection of Rights and fundamental freedoms.

The petition was served to the Office of the Inspector General as the first respondent, Director of Criminal Investigation, Director of Public Prosecution, the Chief Magistrate Court Nairobi and the Attorney General as the fifth respondent.

With Galot Industries Limited being the first interested party and Manchester Outfitters Limited the second interested party also.

Under the Constitution of the Republic of Kenya, articles 27,28,29,31,40,41 and 47 threats to convention of rights.

The Petitioners Mohan Galot, Rajeev Modi, Pushpinder Singh Mann and Jophece Yogo are seeking justice on their violation of their rights, unlawful arrests and fabrication of wild malicious charges unconstitutionally with the possible outcome of the offenders facing full wrath of the law…..
