CLASS SEVEN PUPIL GIVE KENYAN INSPECTOR GENERAL 7 DAYS TO APOLOGISE FOR UNLAWFUL ARREST, CUSTODY AND BEING CHARGED

Through his Attorney Ojwang, D for : Ochich, TLO and Associates, in

a complaint letters served to Kenyan Inspector General of Kenya

National police service, Hillary Mutyambai, the Independent Police

Oversight Authority, Director of Public Prosecution, Ethics and Anti

Corruption Commission and Commission on Administration of

Justice, the complainant a primary school pupil want Langata OCS

and 8 other officers be investigated, interdicted and charged in  a

Kenyan lower criminal Court.

 

 

 

 

The orphan, Slum boy, Lameck Joseph Juma Schooling at a primary

school within the Capital City of Kenya, one among  the great

performing schools, a resident of Raila Estate in the Sprawling slum

of Kibera born and bread in the densely African Populated Slum , is

alleging that he was unlawfully arrested on Sunday 30th May year

2021 by patrolling Police Officers based at Langata Police station

Nairobi County Kenya, unlawfully detained together with adults

contrary to the law on Children rights at the said Station cells and

on Monday 31st May year 2021 arraigned before Nairobi’s Kibera

Law Court Chief Magistrate, where he was charged together with

adults, instead of  being taken to children’s court and pleaded not

guilty to preparation to commit a felony, regardless to his situation

of being a School going incoming KCPE candidate.

 

 

 

 

The Teenage rights and fundamental freedoms was violated by the

alleged arresting Kenyan Police Officers, in recognition and

protection of human freedom and dignity, a right to all Citizens of

Kenya and not a gift or a favour, that is clearly spelt out in the

Country New 2010 Constitution in Article 19, clause 2,3 roman (a)

 

 

 

 

Lameck Joseph Juma argues through his officers of the Court that

his right to basic education and violence, inhuman treatment and

punishment has been violated by the same State that is mandated to

adhere to law by enforcement. Under Article 53 of the Constitution.

 

 

 

 

It was on Sunday May 30th year 2021 at Raila Estate within the

Sprawling slum of Kibera near the Government of Kenya newly

built Road the Southern bypass, where he was arrested by Police

Officers on patrol after he was send to the shop to buy basic

necessities by his ailing grandmother, a guardian who is taking care

of him after both his parents passed away many years ago.

 

 

 

The law in Article 49 of the Constitution of the Republic of Kenya,

the rights of arrested person in clause 1, roman (a) clearly says that,

the arrested person has a right to know the reason of arrest and to

be informed promptly on the offences being a accused of, an issue

which he’s not taking lightly where he alleged that the arresting

officers intentionally failed to disclose to him the offence and

utilised the opportunity to allegedly harass him by fabricating

serious criminal charges that attract hash penalty for allegedly

failing to adhere to their demands of being gifted.

 

 

 

 

The Class Seven pupil at Uhuru Garden Primary School Nairobi

County Kenya, was frogmarched together with other arrested

suspected youth, where he alleged that he was detained without

being booked at the Police Occurrence Book together with adults

despite him being a minor, where the law requires him to be

detained at the Government Children Centre and was charged with

alleged fabricated offence.

 

 
His guardian the ailing grandmother has no idea where her

grandson is, very much disturbed on his whereabout and safety

including the school administration on his absenteeism, being a

candidate who should be concentrating with his studies to prepare

for the primary school final examination together with other KCPE

candidates.

 

 
On there social media walls, the complainant Lameck Joseph Juma

through his Attorney, alleged that the National Police service

Officers after realising their alleged misdoings, mistakes and the

sensitivity of the matter, decided to post on their usual social media

sites that, the minor a class seven pupil at Uhuru Gardens Primary

School, is one of the alleged criminals who has been robbing Road

users along the Southern bypass armed with lethal and crude

weapons , where he was charged alongside other suspects with

preparing to commit a felony at Kibera Law Court Nairobi County

Kenya on Monday 31st May year 2021.

 

 

 

 

Through his Officer of the Court Ojwang, D for : Ochich, TLO

Associates, the accused, a minor Lameck Joseph Juma has authored

several letters, directed to several Institutions in the Country

including the Office of Cabinet Secretary for Internal and

Coordination of National Government Dr. Fred Matiangi ,

demanding for the withdrawal of the alleged fabricated charges and

unconditional release from unlawful custody to be able proceed

with his studies.

 

 
The minor also is demanding an apology from Langata

Commanding Police Station Nairobi County on behalf of the

arresting officers for messing up with his life, Schooling

programme, causing unnecessary distress to his ailing grandmother

and to clear his image from the record of suspected criminals for

the sake of his brighter future.
