PARAMILITARY OFFICER GUARDING KENYAN PRESIDENT JAILED FOR TWO YEARS WITHOUT FINE

A Kenyan General Service Unit (GSU) officer

tasked with the sensitive duty of guarding the

Country Head of State was on Friday 11th

December 2020 at 2.33 pm East Africa Time,

jailed for two years without an option of fine by

Nairobi’s Senior Principal Magistrate Helen

Onkwani.

Edwin Nyariki Otiso in his 20s and a father of

young family who stole a pistol from the

Country State House Armoury, the most

Protected Area in the Republic of Kenya will

spend a cool two year jail term at Kamiti

Maximum Prison Nairobi County.

His co accused who is his uncle Justus

Nyamwaya Aunga got a relief after the Court

found out through a probation report that he

was a victim of circumstances and sentenced

him to a noncustodial two years , with a

strict warning to maintain peace and any

offence he will commit within the two years

noncustodial sentence will result to him serving

the two years noncustodial sentence to

custodial without an option of fine.

Nairobi was found guilty of two counts of

stealing and handling stolen property.

Onkwani convicted the two, a General Service

Unit Officer (GSU) Edwin Nyariki Otiso and

Justus Nyamwaya Aunga his uncle who was

working in a Construction Company within

Nairobi Industrial Area.

After the investigating officers found the

said stolen pistol from his house and was

unable to narrate to the officers how the stolen

pistol found his way to his house, where in his

defence hearing the second accused informed

the court that the first accused appeared in his

house with a bag and begged him for storage

unaware of what was carried.

Mitigating through their officers of the Court,

the former GSU officer Edwin Nyariki in his 20s

pleaded with the trial Court for leniency, non

custodial sentence and also informed the Court

that he’s a father of two with one wife as he’s co

convict Justus Aunga was very remorseful, he

also informed the Court that he’s a father of

three school going and the sole breadwinner.

The Court was informed that on 28th and 29th

October the year 2017 at State House Nairobi

GSU Armoury within Nairobi County Kenya,

jointly stole a firearm namely Jericho Pistol

worth 0.2 million Kenya shillings and fifteen

rounds of ammunition the property of National

Police Service.

In a separate charge the two convict were found

guilty to have handled the stolen property

belonging to National Police Service.

During the hearing the State Prosecutor James

Gachoka called several witnesses who testified

against the two convict and submitted closing

the case and urging the Court to place the two

on their defence since the State proved solid

evidence against the two convicts.

Edwin and Justus were arrested from their

hideouts in Kawangware Sprawling slums

within Nairobi on 04th November 2017 and

charged on 06th November at the lower

Criminal Court Milimani Nairobi County Kenya.
