Former National Land Commission Vice
Chairperson Abigael Mbagaya told the
trial court that the disputed land at
Donholm Nairobi belongs to GidJoy
investment Limited.
The former commissioner who was also the
chair of Review of grants committee of
the commission at the time was
testifying in an going criminal matter
where four accused were charged with
several counts of forgery, falsifying
documents , making of documents and
conspiracy to defraud.
Whereby the accused Peter Gitau Muiruri,
Peter Njoroge Kanika , Hoops Shihemi
Alexander and Patroba Odoyo Awino were
charged with five counts and pleaded not
guilty.
The accused were released on hash bond
terms after pleading with the court that
they will attend the trial.
The State Prosecution told the trial
court that the accused with intend to
defraud conspired to defraud Ms. GidJoy
investment Limited land parcel measuring
11.8 acres situated at Donholm valued
at Ksh. 944,000,000 by falsely
pretending that they had genuine title
deed issued by land registrar.
It is also alleged that the accused made
false documents purporting to be
genuine and also forged title deed
claiming issuance by registrar.
And in a separate charge the accused
also falsely made a document namely a
letter of allotment purporting it to be
a genuine letter of allotment signed by
Land Administration Officer.
National Land commission is mandated to
manage public land on behalf of the
national and county governments ,
recommend a national land policy to the
national government and advise the
national government on a comprehensive
programme for the registration of title
deed of land throughout the Country.
National Land Commission is also one of
the independent commissions established
by Chapter 15 of the Kenyan
Constitution.
The witness Abigael identified the first
and second accused person before court.
Commissioner Abigael Mbagaya’s term
ended in 2019 as a Vice Chairperson of
the National Land commission.
The State witness told the court that
the disputed land is Nairobi block
82/7333 and is located at Donholm
Nairobi County where she again confirmed
that it belongs to GidJoy investment
Limited.
