The State Prosecutor has informed
the court that inline to section 78 of
the evidence act, the photos
produced during GidJoy land
grabbing trial before it are inline
with the act.
The witness a crime scene
investigator while testifying
produced photos of a perimeter
wall allegedly destroyed by the
accused.
In the amended section 78 of
evidence act , it allows all gadgets
that can take photos including
phones to be allowed as evidence
before a court of law.
The certificate produced by the
witness during the trial is compliant
and inline with the evidence act.
The state witness told the court that
the ten accused damaged a perimeter
wall of a land belonging to GidJoy
investment Limited.
The Directorate of Criminal
Investigations officer further told the
court that the accused damaged wooden
polls and also cut the barbed wire .
Senior Principal Magistrate Gilbert
Shikwe will deliver a ruling on 8th
December on the issue of evidence act .
The Witness also presented a
certificate before court to confirm
that the photos were produced
before suspect
The Detective was testifying in a
Criminal case where ten accused were
charged with two counts of malicious
damage and Forcible entry contrary to
section 339 (1) and 90 of the penal
code.
The accused Benita Alando Nathaniel ,
Peter Keya Owino , David Makau Mutuku ,
Kennedy Odhiambo Alex, Tutus Ochieng
Okoth , Boniface Oduor Onyiengo,
Calvince Ochieng Ooko, Patrobas Awino ,
Nick Omondi Owango , Philemon Otieno
pleaded not guilty and were released on
a cash bail.
The disputed land is Nairobi block
82/7333 and is located at Donholm
Nairobi County where it has been
severally been confirmed by the land
registrar that it belongs to GidJoy
investment Limited
