KENYAN HIGH COURT JUDGE JOEL NGUGI AT THE CENTRE OF PROPERTY DISPUTE ACCUSED OF UNPROFESSIONAL BEHAVIOUR

HIGH COURT JUDGE JOEL NGUGI AT THE CENTRE OF PROPERTY DISPUTE ACCUSED OF UNPROFESSIONAL BEHAVIOUR

Through a letter received by the employer, the Judicial Service Commission (JSC) on the conduct of a serving Judge in Kenya, Justice Joel Ngugi.

The the Complainant, the impulse Holding limited want the Judges Employer Judicial Service Commission (JSC) to prefer disciplinary measures against the serving Judge at the centre of the property storm .

The complainant in the letter that was send to JSC on 18th of October 2019 and was received stamped by the employer (JSC) on 28th October 2019, argue that the Judge being a second buyer of the disputed plot prevented developers seeking to develop their alleged legal plot.

The law prohibits the serving /sitting Kenyan Judges from openly and publicly engaging in business activities and acquiring properties that might compromise their profession.

Since as a serving /sitting judge the outcome of their work might be compromised with the businesses they are openly and publicly engaged or acquired properties that are in disputes .

The complain forwarded to the Judges employer the Judicial Service Commission (JSC), the complainant in their second last paragraph of their complain letter.

Accuses Justice Joel Ngugi of disrespecting the Judicial code of conduct and wants the JSC to act on the conduct of the said Judge.

They also accuse the Judge of using his powerful position to intimidate Civilian citizens at the expense of his personal interests.

It is alleged that the property at Lavington Nairobi County which is under dispute, the Judge allegedly directed his armed body guard to intimidate the developers who authored the complain letter to JSC.

The letter to JSC is on the conduct of Justice Joel Ngugi, a serving Judge of the High Court of Kenya.

As regards to his alleged unprofessional conduct in the dispute surrounding the ownership of two properties in Lavington Nairobi County.

The Complain letter against Justice Joel Ngugi was also send to the Judiciary employer Judicial Service Commission (JSC) through an email.

In another ongoing property dispute matter before Justice Elijah Obaga at Milimani law Court.

Justice Joel Ngugi and others are being accused by the developer of the alleged property, of filing applications to buy and delay time preventing them from developing their alleged property.

The eight home owners on the alleged property in dispute include a sitting Member of Parliament for Kibwezi, his wife and others.

The developer in there submission before Justice Elijah Obaga said that they are incurring huge sums of losses.

In the Property row involving the developer and several, eight in number, the home owners among them the elected Member of Parliament Patrick Musimba and his wife Angela.

Including the alleged Judge at the center of the storm of property ownerships within the environment of Nairobi County Kenya, Justice Joel Ngugi.

The parties filed an application before Judge Elijah Obaga seeking an Officers of the Court representing the other parties who claims ownership of the land and wants to develop it, to excuse themselves from the ongoing matter.

A move which was described by the developer Guangzhou Villa as time buying tactics by the alleged parties claiming ownership and home owners.

The home owners want the law firm of Ogolla Okelo & Co. LLP Advocates to withdraw from the ongoing hot property ownership matter.

The home Owners are being represented by Senior Counsel Paul Muite and the matter is set to be heard on Tuesday 05th November 2019 at Milimani law Court Nairobi County Kenya.

It is also alleged that Judge Joel Ngugi allegedly prevented property owners at Lavington disputed land by using his Official Government vehicle in blocking the developers from accessing the property.

State Officers or employees are guided when it comes to usage and disposals of Government Properties in their possessions.

The alleged actions and conduct of Judge Joel Ngugi at Lavington disputed property is absolute abuse of office powers .

In the matter filed at Milimani law Court before Justice Elijah Obaga, the alleged Property owners in calling for the firm of Ogolla to withdraw from the matter.

They want the Lawyer representing the developer in the disputed property to be subjected to cross examination in the ongoing property matter .

As the developer Guangzhou Villa cry foul, that the order issued preventing there company from developing the disputed land was not issued properly.

The developer claims that the stopping orders were issued in the absence of other parties contrary to the laid down procedure.

And instead of moving on with the hearing of the matter, other parties filed application seeking the removal of an Officer of the Court in the matter.

A move the developer Guangzhou Villa protested against and termed it as purely time buying and a scheme to stop them from developing their alleged legal property.
