Tycoon suspected Land Fraudster to be charged

Nairobi’s Chief Magistrate Francis Andayi during a short ruling at

Milimani Law Court Nairobi County Kenya, directed the suspect

Abdirashid Abdul Sharifow allegedly involved in land scandal to

appear before court on Friday 07th May 2021 at 9am East Africa

Time for plea taking.

 

 

The suspect Abdirashid who was arrested on Wednesday 05th May

by Special Assignments Detectives Wanga Masake and Peter Orwa

on allegations of personating contrary to section 382(1) as read with

section 36 of the penal code and obtaining registration by false

pretences contrary to section 320 of the penal code, through his

lawyer submitted an oral application before the Court objecting to

plea taking, informing the court that his client is feared to have

been infected by coronavirus the deadly pandemic Globally and

therefore was seeking the court permission and plea deferral to

seek medical checkups.

 

 

Whereby in response, the State Senior Prosecutor Furchaka

objected the defence submission on grounds that no documentary

evidence and medical results including drug prescriptions

presented before the court to support the defence oral submission.

 

 

The Chief Magistrate Milimani lower criminal Court Francis Andayi

dismissed the application but issued an order for the verification of

a High Court order which was presented by the suspect through his

lawyer stopping the prosecution of  Abdirashid Abdul Sharifow.

 

 

It is alleged that the suspect in early January year 2018 and late

June year 2020 at the ministry of lands Headquarters within

Nairobi County Kenya, jointly with others  he intentionally and

wilfully procured registration of land title deed falsely pretending

to be genuinely obtained and a valid registered owner of the said

property.

 

 

Abdirashid Abdul Sharifow also faces charges of personating where

it is alleged that on Wednesday 05th May year 2021 at the

Directorate of Criminal Investigation (DCI) Headquarters within

Nairobi County Kenya, he presented himself to Senior DCI officers

Wanga Masake and Peter Orwa as Zainulabidin Shariff a fraudulent

registered owner of percel of land under investigation.

 

 

The State prosecution will address the court on Friday 07th May on

authentic of the alleged High Court order stopping the prosecution

of Tycoon Abdirashid Abdul Sharifow.
