WIDOWER WHO WITHDREW ACCIDENTALLY SENT MPESA MONEY TO HIS PHONE JAILED

Writings on the wall, if by any chance you

receive accidentally sent mpesa money,

Please prevent or stay away from More

suffering in Kenyan Maximum Prisons

by sending the money back to the owner.

 

 

 

 

As the father of two school going lower primary

school pupils, a widower, sole bread winner and

the first born, Convict Cyrus Nzoka will spend a cool three

months in one of the Country Maximum prison or

pay a fine of 20,000 Kenya shillings to purchase

his freedom.

 

 

 

 

Nairobi’s Senior Principal Magistrate Martha

Nanzushi at Milimani Law Court on Monday

28th June year 2021, at 9am East Africa Time,

Sentenced the accused to a lenient sentence

on his own admission of being guilty.

 

 

 

 

The bad, ugly and unacceptable mischievous

behavior, where majority of Kenyans after

accidentally receiving MPESA money and

quickly rushing, withdrawing the cash for their

own personal use, money that do not

belong to them, is a very common behaviour

within the Country.

 

 

 

 

Even with the aggressive efforts of the

Giant Telecommunications in the Country

Safaricom, inventing quicker methods to revert

the accidentally sent money back to their

owners, still they are mostly beaten at their own game or mpesa

anti theft measures.

 

 

 
The law, Section 322 (1) as read with section

322 (2) of the penal code, prohibits the

fraudulent habit, if found and arrested, the

offenders are charged with stealing and

handling stolen property.

 

 

 

 

Several innocent Safaricom subscribers and

MPESA users, on many occasions has reported

complaints with the giant telecommunications

company Safaricom and the Country Law

enforcement units, hoping to recover money

sent accidentally, but their missions on several

occasions has never been successful.

 

 

 
Since the receiver’s of accidentally sent money

always switch off their mobiles phones or quickly

withdraw the amount of money before the senders

or victims realises.

 

 

 

 

The accused Cyrus Nzoka was arrested on

Thursday 24th June year 2021 after the complainant reported

an act of theft at the Capital City Central Police

Station, Nairobi County Kenya and was

arraigned before Nairobi’s Senior Principal

Magistrate Martha Nanzushi on Friday 25th

June at 9am East Africa Time , where he was

charged with two counts of stealing and

handling stolen property .

 

 

 

 

Cyrus Nzoka Maithya in his 50s pleaded guilty

to receiving 16 ,463. Kenya shillings sent

accidentally to his phone by Harriet Karimi a

widow and intentionally, unlawfully withdrew

the money belonging to the complainant and

channeled it to his personal use.

 

 

 

 

in her statement the complainant Harriet Karimi

indicated that the money sent accidentally to

the accused Cyrus Nzoka , was being wired to

the City hospital account office to clear

medical bills of one of her family member

admitted at the said City medical institution.

Convict Cyrus Nzoka a widower and a first born

in a family of five, sole bread winner. Wasted

the greatest opportunity given by the trial

Senior Principal Magistrate Martha Nanzushi,

where he was given an option to refund the

money to the complainant Karimi also a widow

by Monday 28th June year 2021, but fate was

not on his side, he will spend three months at

Kamiti Maximum Prison and also serve as an

example to majority of Kenyans with similar

unprofessional attitudes.
