A TENANT WITH ORDERS STOPPING THE LANDLORD FROM EVICTING HER WAS SHOCKED TO FIND HER PROPERTIES VANDALISED AND STOLEN

The Officer Commanding Police Station at Langata Nairobi County arrested the Agent, Sort Masters Limited after Properties under his watch was stolen.

The criminal offence was discovered when the applicant went to serve the landlords with Rent Tribunal orders allowing her to continue with her operations pending the hearing of the matter in two months.

The Tenant Cynthia Wambui successfully got orders barring the landlord, Turitu service Station limited the first respondent, HFC limited the second respondent and Sort Masters Investment limited the third respondent and Estate agent.

The three through a Rent Tribunal orders were barred from locking, stopping the applicant /tenant and interfering with the operations of the applicant pending the hearing of the matter.

Cynthia Wambui who rented the premise and her lease was scheduled to expire in the year 2024, filed a complain before Rent Tribunal after her contract with the landlord was breached.

In a her application the tenant who operates Laibon villa and Guest house at Nairobi West, alleged that the second respondent without following the law went a head and purchased the premise at a throw away price of 209 millions Kenya shillings.

The second respondent happened to have loaned the applicant 200 million Kenya shillings to purchase the said premise years back.

Later while the applicant was repaying her loan to the second respondent, without informing her of their interest.

The second respondent the landlord organised a tender bidding against the existing laws and miraculous emerged the winner and purchased the premise in dispute, purely a case of conflict of interest.

The current value of the premise at the center of dispute is 400 million Kenya shillings, which was never considered during the said bidding which the applicant believes was a breach of law.

In her several prayers in the application before Tribunal , Cynthia Wambui seeks to continue operating her business and wants the three respondent stopped from interferences.

Through her Officer of the Court Mwenda Njagi and Co Advocates, the applicant now want the law enforcement unit to prefer charges against the three respondents.

While on a mission to reclaim her business through tribunal orders, the business lady discovered a mess within her properties in the premise.

All the vital documents, CCTV cameras stolen destroyed and other business properties were vandalised.

Disabling her totally and unable to immediately resume running her business which is situated at Nairobi West, Nairobi County as directed by the Rent Tribunal orders.

The alleged criminal act was immediately reported at Langata Police station Nairobi County and the three respondents held as suspects.
