STATE LAW OFFICE ACCUSES PRAVIN GALOT AND RAJESH GALOT OF BREACHING LAW

Pravin Galot and Rajesh Galot has continuously breached the High Court Orders barring them from declaring themselves in public, that they are the Directors and Shareholders in the application filed by the second plaintiff.

Former State Counsel Ernest Kamau Kaka also intentionally ignored the Court order, outlawing him from representing Pravin Galot and Rajesh Galot as the Directors of Manchester Outfitters Limited.

In response to the application filed by the applicant Mohan Galot, the State law office Attorney General associates with the applicant on the issue of Court orders being breached by the defendants.

While granting orders as sort by the applicant in application filed before Court, Justice Mabeya on 06th July 2012, issued orders restraining Pravin Galot and Rajesh Galot from holding themselves out as shareholders or Directors of the second plaintiff .

The defendants stand warned by Court from taking, making decisions, giving instructions, writing, signing letters, notices, forms, deeds, minutes, resolutions, returns and any other documents in the name or on behalf of the plaintiffs.

And Ernest Kamau Kaka also restrained from acting as the advocate of the plaintiffs in giving instructions, making decisions, signing letters and any other documents in the name of plaintiffs or on behalf of the plaintiffs as regards the plaintiffs company files and records or remaining on property number 209/8314.

The orders were granted by the High Court after the five plaintiffs filed a civil case 430 of 2012 through supporting affidavit which was signed by Mohan Galot and received by the High Court of Kenya on 21st June 2019.

The order granted by Court as sort by the plaintiffs and second applicant was served to the defendants and affidavit of service filed before Court.

Orders were also varied by Justice Musinga on 10th July 2012 and the honorable Court enhanced the orders by urgently urging the applicant the second plaintiff Manchester Outfitters Limited to continue with it’s operations.

That’s included procurement, signing of cheques to effect various transactions and the first and second Defendants Pravin Galot, Rajesh Galot to run the Company strictly as managers and to be paid salaries by the second plaintiff Manchester Outfitters Limited, there status in the company remains as employees.

Justice Musinga while effecting the order granted by Justice Mabeya in the same year, warned the defendants Pravin Galot, Rajesh Galot and Ernest Kamau Kaka from holding themselves as Directors and Shareholders of the second plaintiff Manchester Outfitters Limited.

In disregard of the Court order and in total disrespectful to the Court, Honorable Judges of the High Court of Kenya, the defendants breached the Court order, continued calling the shorts in the company and imposing themselves as the Directors and Shareholders of the second plaintiff and the applicant.

And to make matters more worse the first and second Defendants Pravin Galot and Rajesh Galot, the defendants who were appointed at the Company Manchester Outfitters Limited as employees by order of Court.

Disobeyed and breached the terms, conditions of Justice Mabeya paying themselves huge amounts of money, travelling overseas with their families in first class tickets which are very expensive and making several trips at the Company expenses blatantly without the approval of the board.

The letters authored on 05th June 2013, 09th July 2013 and 24th July 2013 proved that the defendants disrespectfully, totally breached the Court Orders and acted as Director, Executive Director, with Ernest Kamau Kaka purportedly and illegally acting for the five plaintiffs Contrary to the law.

The five plaintiffs Galot Limited, Manchester Outfitters Limited, Galot Industries Limited, King Woollen Mills Limited and Galot International Limited now wants the three defendants Pravin Galot, Rajesh Galot and Ernest Kamau Kaka be committed to two years civil jail for disobeying the law Court of the Republic of Kenya.

It is also on record that the defendants acting for themselves against the Court orders mismanaged, misused and abused their powers as employees of the second plaintiff the applicant by awarding themselves huge company proceeds.

And unnecessarily engaging in luxurious lifestyles, buying assets such as house’s and also acquiring top range of motor vehicles illegally, using Manchester Outfitters Limited their employers resources Contrary to their monthly salaries as employees.
